Drive while Unlicenced
The offence of ‘Drive while Unlicenced’ is contained under Section 53 of the Road Transport Act 2013 and occurs when a person who is unlicenced or has never been licenced drives a motor vehicle on a public road. The maximum penalty for a first offence is a fine of $2,200. The maximum penalties for a second or subsequent offence is a fine of $3,300 and/or 6 months imprisonment. Drive while Licence Cancelled
The offence of ‘Drive while Licence Cancelled’ is contained under Section 54(4) of the Road Transport Act 2013 and occurs when a person drives a motor vehicle on a public road when their licence has been cancelled. The maximum penalties for a first offence is a fine of $3,300 and/or a 6 months’ imprisonment. The maximum penalties for a second or subsequent offence is a fine of $5,500 and/or 12 months imprisonment. This offence also carries licence disqualification periods.
