Minor theft is an alternative charge to theft. Minor theft is appropriately laid where the value of the property allegedly involved is $2000 or less.

The maximum penalty for minor theft is a fine of 50 penalty units and/or six months’ imprisonment.

The elements of minor theft, what the police must prove and the possible defences are the same as for theft.

As the maximum penalty is only six months’ imprisonment, minor theft is a “summary-only” matter and will be heard in the Magistrates Court.
