In New South Wales, criminal law matters are dealt with in the Magistrates Court, Children’s Court, District Court and Supreme Court depending on the charges and the age of the accused.

Magistrates Courts

The NSW Magistrates Court deal with the bulk of criminal law matters, including traffic matters. If you have been charged with summary offences such as trespass, disorderly behaviour or drink driving, your matter will be finalised by a magistrate. If you have been charged with a more serious offence such as assault or larceny, your matter may still be finalised by a magistrate, depending on the situation.

District Court

The NSW District Court deals with some serious criminal matters such as serious assaults, sexual assaults and burglary matters. It also hears appeals against decisions by the Magistrates Court and Children’s Court.

Supreme Court

The NSW Supreme Court deals with the most serious criminal matters, such as murder and manslaughterterrorism offences and treason. It also hears appeals against decisions by the lower criminal courts.
